Privacy Policy
This policy describes how The New Black AI collects, uses and protects your personal information across the web application.
1. Information we collect
When you use The New Black, we may collect the personal information you give us such as your name, address and email address. We also automatically receive your computer's internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
2. Consent
When you provide us with personal information to complete a transaction or verify your credit card, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
If after logging in you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at team@thenewblack.ai.
3. Hosting
All your information, images, videos and resources are hosted on AWS, Amazon Web Services, Inc. 410 Terry Avenue North, Seattle, WA 98109-5210, U.S.A.
4. Google user data
When a user connects their Google/YouTube account to The New Black, we may access limited Google user data authorized by the user through Google OAuth. For YouTube publishing, this may include the user's Google account identifier, email address, profile information, OAuth access and refresh tokens, and the permission required to upload videos to the user's YouTube channel.
We use this Google user data only to provide the user-requested feature of connecting a YouTube account and publishing videos created or selected by the user in The New Black to the user's own YouTube channel. We do not use Google user data to edit or delete existing YouTube videos, and we do not use Google user data for advertising.
Store connections. A user may also connect, one at a time and each with its own permission, Google Search Console, Google Analytics, Google Ads, Google Merchant Center and YouTube Analytics, to see their own store's results on their Store page in The New Black. For these connections we read, when the user opens the page, the data the user authorized: Search Console search performance and URL inspection results for the user's own site; Google Analytics reports for the user's own property; Google Ads campaign metrics for the user's own accounts, and, at the user's request, changes to the status or budget of the user's own campaigns; Merchant Center product statuses and free-listing performance for the user's own account; and YouTube Analytics reports for the user's own channel. This data is displayed only to the account that connected it and is not stored, except the connection tokens (encrypted at rest) and the identifiers of the assets the user chose (site, property, customer, account, channel). Disconnecting a connection stops its use immediately.
We do not sell Google user data. We do not share, transfer, or disclose Google user data to third parties except as necessary to provide and operate the service, comply with applicable law, protect our rights or users, or with the user's explicit consent.
Google user data may be processed by our infrastructure and service providers solely for hosting, storage, security, logging, and operation of the service. These providers may include Amazon Web Services (AWS), Supabase, and other technical processors that act on our behalf and under appropriate confidentiality and security obligations.
When a user publishes a video to YouTube through The New Black, the video content and related metadata chosen by the user, such as title, description, tags, and visibility settings, are transferred to YouTube/Google for publication on the user's YouTube channel.
Users can revoke The New Black's access to their Google account at any time from their Google Account permissions page: https://myaccount.google.com/permissions. Users may also contact us at team@thenewblack.ai to request deletion of Google-related connection data stored by The New Black.
The New Black's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
5. LinkedIn Page data
When a user connects LinkedIn to The New Black, we access, through LinkedIn's Community Management API and with the user's OAuth consent, the list of LinkedIn Pages (organizations) the user administers, each Page's identifier and name, and OAuth access and refresh tokens. The connection is to a Page, never to the user's personal profile: The New Black does not post on, read, or analyse personal profiles.
We use this data only to provide the features the user asked for: publishing, to the user's own Page, the images, videos and captions the user chose in The New Black; and reading the user's own Page's published posts (date, text, image, link) to show them on the user's Newsletter & social agenda in The New Black. We do not read, display, store or process reactions, comments, or the identity or profile of LinkedIn members who interact with the Page's posts.
What we store: the connection tokens (encrypted at rest), the identifiers and names of the Pages the user connected, and a cache of the user's own Page posts as read from LinkedIn (date, text, image, link), refreshed each time the agenda is opened and deleted when the connection is removed. This data is displayed only to the account that connected it. We do not sell LinkedIn data and we do not share it with third parties except our infrastructure providers acting on our behalf (see Hosting).
Users can disconnect LinkedIn at any time from Profile › Connectors in The New Black, which deletes the stored connection and its cache, and can revoke The New Black's access from their LinkedIn settings (Settings › Data privacy › Permitted services). Users may also contact us at team@thenewblack.ai to request deletion of LinkedIn-related data stored by The New Black.
The New Black's use of LinkedIn data adheres to the LinkedIn Marketing API Terms and LinkedIn's data storage requirements.
6. Security
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
7. Age of majority
By using The New Black, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use The New Black.
8. Changes to this policy
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on The New Black. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
If our software is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to provide you our service.
9. Requests from public authorities
We disclose personal data to a public authority only when we are legally required to, after reviewing the legality of the request, with the right to challenge it, limited to the minimum necessary, and recorded in a register. The full policy is published at thenewblack.ai/government_data_requests.
